The court restricts CBN, RAMFC, AGF, and others from withholding Kano LG allocations

The Attorney General of the Federation (AGF), the Central Bank of Nigeria (CBN), the Revenue Mobilization Allocation and Fiscal Commission (RAMFC), and others are prohibited from withholding monthly allocations to the 44 Local Government Areas of Kano State by an interim order issued by a Kano State High Court, which is presided over by Justice Ibrahim Musa Muhammad.

The Central Bank of Nigeria (46th defendant), the Accountant General of the Federation (45th defendant), RAMFC (47th defendant), all 44 Kano Local Government Areas, and eight commercial banks are among the respondents listed in the lawsuit.

Additionally, Justice Muhammad granted the applicants’ request to use a courier to deliver court documents to the defendants.

A copy of the court order states: “An Order of Interim Injunction is hereby granted restraining the 45th to 54th Respondents…from withholding, refusing to disburse, delaying, deferring, or suspending the monthly allocation from the Federation Account to the 44 Local Governments of Kano State, pending the hearing and determination of the Motion on Notice.”

Outside of the court’s jurisdiction, the applicants were also given permission by the court to issue and serve the originating processes on the AGF, CBN, and RAMFC at their respective offices in Abuja. For this reason, Red Star Express Plc has been designated as a special bailiff.

The case has been adjourned to November 21, 2024, for the hearing of the Motion on Notice.
