CONSENT JUDGEMENT
This suit was filed in this Honourable Court by a Writ of Summons dated 5th day of April, 2018 and filed on the 11th day of April, 2018.The claimant claimed against the defendant as follows:
- A DECLARATION that the Plaintiff’s entitlements as his severance package from the defendant having being mandated to resign from its employment on 16th February, 2009.
amounts to N2,667,481:43 (Two Million Six Hundred and Sixty Seven Thousand, Four Hundred and Eighty One Naira, Forty Three Kobo) only.
- AN ORDER directing the defendant to pay the plaintiff forthwith his severance package/entitlement in the sum of N2,667,481:43 (Two Million Six Hundred and Sixty Seven Thousand, Four Hundred and Eighty One Naira, Forty Three Kobo) only.
- 10% interest on the Judgment sum from the day of the Judgment until the amount is fully liquidated.
- Cost of this Action.
That while the matter is pending before this Honourable Court both parties have considered an out of court settlement of the matter
On the Tuesday 4th day of March, 2020 the matter came up for report of settlement and the parties filed their terms of settlement dated 19th day of February, 2020. The terms of settlement have been adopted as consent Judgment of this Honourable Court as contained in paragraphs a, b, c and d of the terms of settlement. The terms which was duly executed by the counsel to both parties state as follows:
- The Claimant claims to be an erstwhile staff of Platinum Habib Bank Plc.
- The Claimant instituted this action Suit No. NICN/KN/15/2018 for the sum of N2,667,481:43 as his severance package owed by the aforesaid Platinum Habib Bank Plc from the Defendant.
- While the matter is pending before this Honourable Court both parties have considered an out of court settlement of the matter.
- The Defendant unequivocally denies the claim of the claimant in its entirety but has on compassionate grounds agree to make an ex-gratia payment the sum of N496,317:52 (Four Hundred and Ninety Six Thousand, Three Hundred and Seventeen Naira, Fifty Two Kobo) only. as full and final settlement of the claims of the Claimant.
Court:
Having heard the Counsel representing the parties. The terms of settlement filed on the 4th day of March, 2020 is hereby adopted as the Consent Judgment of the court.
