SECTION 1
(1) There is established the Federal Road Safety Commission Training Institutions (in this Act referred to as “the institutions”)-
(a) Federal Road Safety Corps Academy;
(b) Federal Road Safety Corps Command and Staff College;
(c) Federal Road Safety Corps Marshal Inspectorate Training School; and
(d) Federal Road Safety Corps Road Marshal Assistants Training School.
(2) The institutions-
(a) shall be bodies corporate;
(b) may sue and be sued in their corporate names; and
(c) shall have perpetual succession and a common seal.

SECTION 2
The Federal Road Safety Commission (in this Act referred to “the Commission”) may increase, vary or delete the institutions specified in section 1 (1) of the Act.
Powers of the Commission.
SECTION 3
The institutions shall offer training in road traffic administration and safety management and related professional training for members of the Corps and other members of the public.

SECTION 4
The institutions shall have power to award certificates to participants in accordance with the high professional standards as may be prescribed by the Commission.

SECTION 5
The functions of the Federal Road Safety Corps Academy are to-
(a) provide members of Federal Road Safety Corps (the Corps) and other participants the opportunity of acquiring qualitative training in road traffic administration and safety management;
(b) provide basic training to Officer Cadets of the Corps;
(c) provide basic and professional training for road safety officers of other nations that the Federal Government of Nigeria may approve;
(d) provide courses of instruction and other facilities for the pursuit of teaching and learning and make those facilities available on prescribed terms to members of the Corps;
(e) nurture, equip and produce globally competitive road safety officers with requisite knowledge, skills, scholarship and attitude suitable for leadership;
(f) encourage and promote academic excellence in the institutions;
(g) conduct and serve as a centre for research in road traffic administration, safety management and other relevant fields;
(h) align its activities to the safety, security, social, cultural and economic needs of the people of Nigeria;
(i) develop in each Officer Cadet the physical attributes and skills necessary to meet the requirements of a commissioned officer of the Corps;
(j) serve as a training Centre of Excellence for management level officers of the Corps, similar agencies, relevant. ministers, department and other agencies;
(k) develop the professional knowledge .and understanding of members of the Corps, similar agencies, relevant ministries, departments and other agencies in order to prepare and equip them for appointment to appropriate positions and promotions in the respective services to which they belong; and
(l) carry out any other activities as are necessary or expedient for the performance of its functions under this Act.
Functions of the Federal Road Safety Corps Academy.
SECTION 6
The Functions of the Federal Road Safety Corps Command and Staff College are to:
(a) serve as a training centre of excellence to train management-level officers of the Corps, similar agencies, relevant ministries, departments and other agencies;
(b) conduct intermediate and senior courses for operational, tactical and strategic level officers of the Corps, sister agencies, relevant ministries, departments and other agencies with a view to expanding their knowledge of the operational and tactical frame work within which road traffic administration and safety management may be carried out;
(c) serve as a research centre for road traffic administration and safety management;
(d) develop the professional knowledge and understanding of the Corps personnel, similar Agencies, relevant ministries, departments and other agencies in order to prepare and equip them for appointment to appropriate positions and promotions in the respective services to which they belong;
(e) prepare and equip personnel of the Corps, similar agencies, relevant ministries, departments and other agencies to function effectively;
(f) award certificates on completion of each training programme which shall authorise a participant to use the designated words and letters “passed staff college” (PSC) for senior course participants and “passed junior course” (PJSC) for junior course participants respectively;
(g) enter into collaborative ventures, affiliation and establish linkages with other institutions or persons for the purpose of building capacity in any related area of learning;
(h) develop programmes and other activities which shall promote excellence in the Staff College;
(i) admit officers from similar agencies, relevant ministries, departments and other agencies within and outside Nigeria for courses of study at the College and where necessary to levy such fees as are prescribed;
(j) conduct study tours for participants, locally and internationally, aimed at enhancing learning and comparative best practices in road traffic management, safety administration and national security; and
(k) carry out any other activities as are necessary or expedient for the performance of its functions under this Act.

SECTION 7
The functions of the Federal Road Safety Corps Marshal Inspectorate Training School are to-
(a) provide members of the Corps and other participants the opportunity of acquiring qualitative training in road traffic administration and safety management;
(b) provide basic training to trainee marshals of the Corps;
(c) provide courses of instruction and other facilities for the pursuit of teaching and learning and make those facilities available on prescribed terms to members of the Corps;
(d) align its activities to the safety, security, social, cultural and economic needs of the people of Nigeria;
(e) develop in each trainee marshal the physical attributes and skills necessary to meet the requirements of a member of the Corps; and
(f) carry out any other activities as are necessary or expedient for the performance of its functions under this Act.
Functions of the Federal Road Safety Corps Marshal Inspectorate Training School.
SECTION 8
The functions of the Federal Road Safety Corps Road Marshal Assistants Training School are to-
(a) provide members of the Corps and other participants the opportunity of acquiring qualitative training in road traffic administration and safety management;
(b) provide basic training to Road Marshal Assistants of the Corps;
(c) provide courses of instruction and other facilities for the pursuit of teaching and learning and make those facilities available on prescribed terms to members of the Corps;
(d) align its activities to the safety, security, social, cultural and economic needs of the people of Nigeria;
(e) develop in each Road Marshal Assistants the physical attributes and skills necessary to meet the requirement of a member of the Corps;
(f) carry out any other activities as are necessary or expedient for the performance of its functions under this Act.
Functions of Federal Road Safety Corps, Road Marshal Assistants Training School.
SECTION 9
(1) There shall be appointed by the Corp Marshal for each institutions a Commandant and a Deputy Commandant, who shall be members of the Corps.
(2) The Corp Marshal may appoint such other staff for the institutions as necessary, who shall be members of the Corps.
(3) A person to be appointed Commandant of any of the institutions shall not be below the rank of Corps Commander Cadre
(4) The Commandant shall-
(a) be responsible for the administration of the institution;
(b) be responsible för the preparation of programmes and place for the institution, to be approved by the Corps Marshal, as are necessary to carry into effect approved training;
(c) keep the records and books of the institution;
(d) hold office in accordance with the Corps’ polling policy;
(e) carry out any other duties as may be assigned to him under this Act or by the Corps Marshal;
(f) the Commandant may, in consultation with the Corps Marshal appoint such other heads of departments or units of the institutions as may be necessary for its proper functioning.

SECTION 10
(1) There shall be established and maintained for each of the institutions a fund into which shall be paid and credited-
(a) all subventions and budgetary allocation from the Federal Government;
(b) all sums accruing to the institutions by way of gifts, endowment, bequest and other contributions from organisations where the terms and conditions attached are cons stent with Federal Government guidelines;
(c) all money needs immediately before the commencement of this Act by the institutions;
(d) foreign aids and monetary assistance received by the institutions under any agreement or arrangement with any international body or organisation with approval of the Federal Government;
(e) fees paid by students other than members of the Corps;
(f) fees, charges, dues or money from publications and other services rendered by the institutions;
(g) revenues accruing to the institutions including interest from money invested by the institutions and such other money accruing to the institutions from other sources;
(h) research grants; and
(i) all other sums which may accrue to the institutions.
(2) All money received by the institutions by way of endowments, gifts or donations shall be entered in a register kept for the purpose, showing the names of donors and any special conditions attached.
(3) Any property, money or fund donated for a specified purpose shall be applied, administered and expended specifically for the purpose it was meant.
(4) The funds of the institutions shall be managed in accordance with extant Regulations applicable in the public service of the Federation.
(5) Any money withdrawn from the funds of the institutions shall be applied for the specific purpose for which it was withdrawn.

SECTION 11
The institutions may apply the funds provided for under Section 10 of this Act to-
(a) pay the cost of administration charges and expenses of the institutions;
(b) discharge the cost of maintaining the institutions;
(c) develop and maintain any property vested in or owned by the institutions;
(d) pay for all purchases made by the institutions and the training of its staff;
(e) publicise and promote the activities of the institutions; and
(f) any other expenditure as may be approved by the Federal Government.

SECTION 12
(1) The institutions may accept gifts of land, money or other property on such terms and conditions as may be specified by the persons or organisations making the gift.
(2) The institutions shall not accept any gift where the conditions attached by the person or organisations making the gift are inconsistence with the functions of the institutions under this Act.
(3) All property, money or funds donated for any specific purpose shall be applied and administered in accordance with the purpose for which they were donated and shall be accounted for.

SECTION 13
The institutions shall keep proper accounts and records of their receipts, payment, assets and liabilities in respect of each year and shall cause their accounts to be audited at the end of each financial year by auditors appointed from the list of auditors approved by Auditor-General of the Federation.

SECTION 14
Each institution shall submit to the Corps Marshal, not later than 30 June in each year, an estimate of the expenditure and income of the institution during the succeeding year.

SECTION 15
Each institution shall submit to the Corps Marshal, not later than 30 June in each year, a report on the activities of the institution during the immediate preceding year and shall include the report of the audited accounts of the institution for that year and auditor’s report on it.

SECTION 16
(1) The institutions may borrow, by overdraft or otherwise such sums as they may require for the performance their functions under this Act.
(2) The institutions shall not, without the approval of the Corps Marshal, borrow money which exceeds, at any time, the limit set by the Corps Marshal.
(3) Notwithstanding sub section (1), where the sum to be borrowed is in foreign currency, the institutions shall not borrow the sum without the prior approval of the Corps Marshal.

SECTION 17
The institutions shall, with the approval of the Corps Marshal, make regulations-
(a) as to the access of members of the public, either generally or a particular class, to premises under the control of the institutions and the orderly conduct of members of the public;
(b) for safeguarding any property belonging to or controlled by the institutions from damage by members of the public; and
(c) for giving full effect to the provisions of the Act.

SECTION 18
The Corps Marshal may give the institutions directives of a general character or relating generally to particular matters, but not to any individual person or case, with regard to the exercise by the institutions of their functions under the Act, and the institutions shall comply with the directives, but no directive shall be given which is inconsistent with the duties of the institutions under this Act.

SECTION 19
All money received on account of the institutions shall be paid in to such accounts as may be approved or any account designated by the Federal Government.

This Act may be cited as the Federal Road Safety Commission Training Institutions (Establishment) Act, 2023.
