AYINLA AJAKAIYE VS AMODU OKANDEJI & ORS

(1972) LCN1547(SC)

In the Supreme Court of Nigeria

Wednesday, February 16, 1972

Case N
umber: SC 117/1971

JUSTICES:

LEWIS JSC

MADARIKAN JSC

FATAYI-WILLIAMS JSC

APPELLANTS

AYINLA AJAKAIYE

RESPONDENTS

AMODU OKANDEJI AREMU ALABI THE DAILY TIMES OF NIGERIA LTD

I. LEWIS, JSC (Delivering the Judgment by the Court): We see no substance in this appeal. We think the learned trial Judge was entitled on the evidence before him to come to the conclusion that the plaintiff failed to prove publication of the libel complained of. The admission that the Daily Times was printed and published did not of itself establish publication. The appeal is accordingly dismissed with 37 guineas costs to respondents.

COUNSELS

Mr. R.A.B. Abari, for the Appellant.

Mr. D .A. Akinloye, for the Respondents.|
