JUDGMENT

  1. Introduction, Claims Counter claims On 15/11/13, the Claimant approached the Court via his General Form of Complaint and sought the following reliefs against the Defendant –

  1. A declaration that the Defendant action to summarily dismiss the Claimant was unlawful and illegal as no case of gross misconduct or other lawful cause was established against him.

  1. A declaration that the Claimant is not liable to refund or pay the alleged sum of =N=457, 000 (Four Hundred and Fifty Seven Thousand Naira only) and =N=458, 805 (Four Hundred and Fifty Eight Thousand, Eight Hundred and Five Naira only) or any other funds, as these funds were never paid to the Claimant but to the other staff members who should be held liable for the funds.

  1. A declaration that all the withheld salaries before and after the purported summary dismissal till the date his appointment is positively determined by the Defendant’s Company shall be fully paid and payment slip should also be issued by the Defendant Company.
