MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): This appeal is also against the same Ruling by Lower Court assuming jurisdiction over the 1st Respondent’s suit and raises the same as Issue 2 of the Appellant in appeal No.CA/L/914/12 which has been fully and completely considered and finally resolved in that appeal.

In order to avoid mere repetition of the submissions made by the parties on the said issue and the views and conclusion of the Court thereon, I adopt the reasoning and conclusion in the earlier appeal No CA/L/914/12 for this appeal. For lacking in merit, the appeal is also dismissed, for reasons set out there in and the Ruling of the Lower Court delivered on the 8/10/12 to the effect that it has jurisdiction to adjudicate over the 1st Respondent’s suit, is hereby affirmed.

Parties shall bear their respective costs of prosecuting the appeal.

JUMMAI HANNATU SANKEY, J.C.A. :  My learned brother, Garba, J.C.A., has afforded me an opportunity of reading before now the lead Judgment just delivered.

My lord has exhaustively dealt with the issues that arose for consideration vis-a-vis

the relevant facts and the applicable authorities. I am in agreement with the reasoning and conclusion contained therein.

I abide by the decision reached in the leading Judgment, and I endorse the orders made therein, including the order as to costs.

UZO I. NDUKWE-ANYANWU, J.C.A.:?I had the privilege of reading in draft form, the judgment just delivered by my learned brother Mohammed Lawal Garba, .JCA.

I am also in agreement that the issues contained in this appeal had been taken care of in CA/L/914/12.

The Reasoning and the conclusions are in order. I have nothing more to add.The appeal is dismissed.
