SECTION 1
The provisions of this Act shall apply throughout the Federal Republic of Nigeria.

SECTION 2
Teachers in Nigeria shall compulsorily retire on attainment of 65 years of age or 40 years of pensionable service, whichever is earlier.

SECTION 3
The Public Service Rule or any legislation that requires a person to retire from the Public Service at 60 years of age or after 35 years of service shall not apply to Teachers in Nigeria.

SECTION 4
In this Act- “teacher” means- (a) an education officer, or someone engaged in teaching, including a technical instructor who teaches trade, technical or a vocational subject, in a secondary school, college or professional department; and (b) a teacher, headmaster or headmistress in a primary school who possesses requisite teaching qualification recognised by the Teachers Registration Council of Nigeria. “Public Service” has the meaning ascribed to it under the Constitution. This Act may be cited as the Harmonised Retirement Age for Teachers in Nigeria Act, 2022.
